Why Israel Is NOT an Apartheid State – Exposing Academic Malpractice in Higher Education

Universities were once bastions of intellectual honesty and critical inquiry. Today, many have become echo chambers for ideological propaganda—none more dangerous than the false narrative labeling Israel as an apartheid state. This accusation is not just misleading; it is legally flawed, ethically bankrupt, and academically fraudulent.

Academic Freedom ≠ Academic Fraud

Academic freedom is a cornerstone of higher education, but it is not a license to fabricate, distort, or promote falsehoods under the guise of scholarship.  According to the U.S. Federal Research Misconduct Policy, the fabrication, falsification, and plagiarism (FFP) of data are serious violations that demand disciplinary action. Similarly, the Office of Research Integrity (ORI), UNESCO’s Global Ethics of Research, and the AAUP’s Code of Ethics explicitly prohibit the distortion of facts for political gain.

Yet, in courses across the country, students are being taught that Israel is guilty of apartheid—a claim rooted in ideology, not evidence. This constitutes academic malpractice, violating both institutional integrity codes and international academic standards.

Understanding Apartheid: The Legal Definition

Under international law, specifically the 1973 UN Apartheid Convention and the 1998 Rome Statute of the International Criminal Court, apartheid is defined as “inhuman acts committed for the purpose of establishing and maintaining domination by one racial group over another.”

Key components include:

  • State-imposed racial laws denying political rights.
  • Forced segregation and movement restrictions based on race.
  • Systematic, legalized oppression of one racial group by another.

This definition is derived from South Africa’s apartheid regime (1948–1994)—a brutal, codified system of racial domination. None of these conditions apply to the modern democratic State of Israel.

Let’s review why Israel does not meet any criteria of apartheid:

Academic Bias and the Abuse of Platforms at George Washington University

At George Washington University, the International Middle East Studies department has partnered with the Middle East Studies Association (MESA), a political organization known for promoting BDS propaganda. Some professors have exploited academic platforms to embed anti-Israel ideology into their coursework under the guise of scholarly analysis.

A key example is Professor Nathan J. Brown, who frequently frames Israel through apartheid analogies in both his writing and lectures. While claiming to offer “nuanced perspectives,” Brown consistently promotes a false narrative that distorts legal definitions and historical facts. His central argument asserts that because the two-state solution is diminishing, Israel and Gaza should now be viewed as one unified state—therefore labeling Israel an apartheid regime. This logic is both flawed and factually incorrect.

The Palestinian people of Gaza are not Israeli citizens. They live under full Palestinian self-governance, having elected Hamas, a U.S.-designated foreign terrorist organization, as their ruling body. Not a single Jew resides in Gaza, and Israel does not control Gaza’s internal governance. Therefore, applying the term “apartheid” in this context is a blatant misuse of international legal terminology.

In April 2023, Dr. Brown appeared on a panel alongside Professor Michael Barnett and Dr. Shira Robinson—both of whom reinforced this misleading narrative without providing balanced perspectives. No pro-Israel scholars were invited to the discussion, making it a one-sided academic echo chamber rather than a legitimate scholarly forum. If these professors were confident in their assertions, they would welcome open debate and opposing viewpoints. Instead, they have turned educational platforms into ideological battlegrounds, suppressing discourse and betraying the trust of their students.

 

Legal & Ethical Consequences for Universities

Violating Research Ethics and Federal Standards:

  • Material Support Statutes (18 U.S.C. § 2339A & § 2339B) make it a federal crime to aid terrorist propaganda.
  • Universities misusing academic platforms to justify Hamas terrorism or brand Israel an apartheid state may be in violation of federal law and Title VI of the Civil Rights Act.
  • The Common Rule and Executive Order 13224 further regulate research ethics and prohibit funding organizations that indirectly support terrorism.

Universities failing to uphold these standards risk:

  • Loss of federal funding.
  • Civil rights lawsuits.

What You Can Do: Holding Academia Accountable

  1. Document the Evidence
    Record lectures, save syllabi, and preserve course materials that promote propaganda or misrepresent facts.

    File complaints with university academic integrity offices, ethics committees, or the Office of Research Integrity.
  3. Engage External Watchdogs
    Work with organizations like FIRE, Brandeis Center, CAMERA, and StandWithUs to challenge academic bias.
  4. File Title VI Complaints
    If Jewish students are harassed or silenced, legal complaints can be filed with the U.S. Department of Education’s Office for Civil Rights.
  5. Publicly Expose the Truth
    Write op-eds, speak at school board or trustee meetings, and use social media to inform the public.

Calling Israel an apartheid state is not just a mistake—it’s a deliberate campaign to distort history, delegitimize a democratic state, and indoctrinate the next generation with lies. The comparison is historically false, legally inaccurate, and morally corrupt.
